Case Summary

S-21-0497 Cynthia A. Parde (Appellant) v. Arlan D. Parde (Appellee)

Appeal from the District Court for Gage County, Judge Ricky A. Schreiner

Attorneys:  John W. Ballew, Jr. and Steven D. Burns (Ballew & Hazen for Appellant) and Terrence A. Poppe and McKynze P. Works (Morrow, Poppe, Watermeier & Lonowski for Appellee)

Civil:  Dissolution of Marriage and Division of Assets

Proceedings below:  After the district divided debts and assets in a Decree of Dissolution of Marriage, the Court of Appeals re-apportioned the division assets.  See Parde v. Parde, 31 Neb.App. 263, 602 N.W.2d 657 (2022).  Appellee petitioned for further review, which was sustained and the matter was transferred to the docket of the Supreme Court.

Issues:  On Petition for Further Review, Appellee alleges that the Court of Appeals erred in the following respects: 1) The Court of Appeals erred in finding that $333,750 of appreciation on nonmarital property is part of the marital estate; 2) The Court of Appeals erred in including the value of the Home Place land Arlan owned prior to marriage as martial property; 3) The Court of Appeals erred in finding that the value of Lenard’s Farm of $129,000 is marital property; 4) The Court of Appeals erred in finding that 25 percent of Grandma’s Farm was not nonmarital property; and 5) The Court of Appeals erred in finding that the martial value of Holmesville Farm is $691,500.
