Case Summary

S-22-0919 In re Adoption of Kate S.; Richard L. and Kelley L. (Appellants) v. Dustin S. (Appellee)

Appeal from County Court for Douglas County, Judge Derek R. Vaughn

Attorneys:  Lindsay R. Belmont (Koenig Dunne, PC, LLO for Appellants) and Lisa M. Gonzalez (Johnson Pekny, L.L.C. for Appellees)

Probate:  Adoption, Abandonment, and Termination of Parental Rights

Proceedings below:  Richard L. petitioned to adopt his stepdaughter and sought to waive the biological father’s consent, but after a hearing, the county court did not grant the adoption.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues:  Appellants make two assignments of error:  1) The county court erred in finding that Dustin did not abandon Kate pursuant to Neb. Rev. Stat. § 43-104; and 2) The county court erred in finding that the district court matters needed resolution prior to litigating the issue of terminating Dustin’s parental rights.
